ToS are subject to change without notice.
✦ Payments are accepted in USD only, through Paypal. The Artist will not accept payment in any other form.
✦ The Artist retains all rights to the original artwork of the purchased character. The Buyer may not claim ownership of the artwork.
✦ The Buyer is purchasing the character for personal use only.
✦ The Buyer must send payment within 2 days of claiming a character, unless the Artist has explicitly specified otherwise or another timeframe has been agreed upon. Failure to pay within the given timeframe revokes the Buyer’s claim to the character, and if there is another interested party, they will be given the opportunity to purchase the character instead.
✦ If the Buyer is unreachable after 2 days of claiming a character before payment is provided by the Buyer, the transaction is considered void and the character will be available to be sold to any other interested party.
✦ The Artist retains the right to reject or cancel the sale of a character at any given time, this includes the right to decline a Buyer for any reason.
✦ The Buyer is prohibited from publishing, merchandising or otherwise profiting off of the character unless explicit permission is given from the Artist. If the Buyer wishes to use the character for commercial purposes, an agreement must first be reached regarding rights, payment, and royalties before materials are produced or distributed.
✦ The Buyer may only resell the character design to a second-hand buyer for the same, or less than the original price. The Buyer may trade or gift the design at their own discretion. It is advised that the new owner is made aware of the TOS they are agreeing to by taking ownership of the character/design, before ownership of said character is transferred.
✦ Characters are non-refundable, but if the Buyer is looking to resell the character for any emergency purposes, the Artist may agree to feature/reshare the design again on their twitter (@jaqdaw) to aid the original Buyer.
✦ The Artist retains the right to display the original character artwork on any personal website, gallery, or journal.
✦ The Buyer may also upload the original character artwork to their personal website or gallery accompanied by a credit line to the Artist, and it must not be a high resolution or unwatermarked version of the artwork.
This includes any additional files that the Buyer is provided with their purchase.
✦ The Buyer is prohibited from making edits to the original artwork. This includes tracing.
Cropping the piece for personal use, such as an icon, is permitted.
✦ The Artist is not responsible for how the Buyer chooses to use or portray the purchased character design. However, the Buyer cannot use the character to promote any illegal or hateful rhetoric, or anything else that breaches any previous articles or risks being blacklisted from future sales.
✦ Designs/commissions/art cannot be bought or sold for NFTs/any crypto currency.
Articles listed in the Commissions section of the TOS may apply.
By sending payment, the Buyer agrees to the above terms. Violation of this TOS may result in the Buyer becoming blacklisted.
